A NEW GLOBAL INITIATIVE ON CONTRACT LAW IN UNCITRAL: RIGHT PROJECT, RIGHT FORUM?

Abstract: At its 45th meeting last summer, the United Nations Commission on International Trade Law (UNCITRAL) considered a proposal for a new “global initiative” in UNCITRAL to further harmonize contract law.  The U.S. government has considered carefully the proposal presented to the Commission. We have consulted extensively with key domestic stakeholders on this issue.  On the basis of these consultations and other analysis, it is our view that the time is not right for undertaking a global initiative. The U.S. government believes that there are less ambitious but more practical alternatives for achieving progress in this area, and that UNCITRAL should continue to focus on such alternatives.
